These Terms of Service (“Terms”) govern your access to and use of the Site and its services, including identity verification and authentication tools (the “Services”). By using the Services, you agree to these Terms, which fully comply with Portuguese law, EU GDPR (Regulation (EU) 2016/679), E-Commerce Directive 2000/31/EC, Consumer Rights Directive 2011/83/EU, Digital Services Act (DSA) (Regulation (EU) 2022/2065), and Directive (EU) 2019/770 on digital content conformity.

User Eligibility
You must be at least 18 years old (age of majority under Portuguese Civil Code, Art. 120) or the applicable age of majority in your jurisdiction. For EU users under DSA (Art. 28) and GDPR (Art. 8), parental consent is required for individuals under 16 years (Portugal aligns with 16+ per CNPD guidelines); we verify age via reliable ID checks and prohibit access for minors without authorization. EU consumers benefit from protections under Directive (EU) 2019/770, including remedies for non-conformity.

Accounts and Obligations
Provide accurate registration data and secure credentials. Prohibited: illegal use, harmful content, interference, impersonation.

User Content
grants a worldwide, perpetual, royalty-free license for Service operation; you warrant rights.

Services Description and Conformity (Directive 2019/770)

Services offer EU-compliant identity tools with objective (e.g., accuracy per eIDAS) and subjective (user expectations) conformity criteria (Art. 8). Modifications notified with withdrawal rights (Art. 19); burden of proof shifts to us after 1 year for non-conformity claims (Art. 12). Site follows European Accessibility Act (effective June 28, 2025, WCAG 2.1 AA) and avoids DSA dark patterns.

DSA Compliance and Moderation Procedures (Art. 14 DSA)
As a DSA online platform, moderation uses automated algorithms (pattern recognition for spam/fraud) and manual review for identity flags, with human oversight for high-risk/age verification cases. Decisions based on EU standards, prioritizing legitimate interests/consent. Complaints/appeals via info@aidentite.app; response within 7 days with reasons/options. No personalized recommendations without consent.

Intellectual Property
Protected by EU/Portuguese IP laws (Copyright Directive 2001/29/EC). Limited personal use license; no ownership transfer.

Fees
Fees stated pre-purchase; EU 14-day withdrawal (digital exceptions with consent).

Termination

Termination for violations; GDPR rights persist.

Governing Law
